Terms of Service

These terms cover your use of Defyd.Health. They are written to be readable, not lawyerly. The key idea: you own your child’s data, we organise it, and the app is not a substitute for a doctor.
1. Acceptance
By creating an account on Defyd.Health, or by using the service, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use the service.
2. Eligibility
Defyd.Health is for parents and legal guardians of children with the authority to consent on the child’s behalf. Account holders must be at least 18 years old. The app is not for children to use directly.
3. Account responsibilities
- You confirm you own the phone number you sign up with.
- You are responsible for keeping your OTP secret and for any actions taken on your account. Tell us at security@defyd.health if you suspect unauthorised access.
- You are responsible for the accuracy of the child information you provide.
4. Not medical advice
Defyd.Health is a record-keeping and coordination tool. It is not a medical device, not a diagnostic service, and not a substitute for a licensed healthcare professional.
AI-generated summaries, flags, and recommended-test suggestions are convenience features. They can be incorrect, incomplete, or out of date. Always consult a qualified doctor before making clinical decisions.
For medical emergencies in India, call your child’s doctor immediately, or 102 (ambulance) or 108 (emergency services).
5. AI feature limitations
AI extraction reads documents and pulls out structured data. It can mis-read handwriting, miss fields, or generate incorrect summaries. Verify against the original document before sharing or acting on extracted information.
6. Sharing with healthcare providers
Share links are a convenience for the parent. You are responsible for verifying the recipient’s identity and that you intend to share with them. Defyd.Health is not liable for any misuse of a share link by the recipient. Links default to a 48-hour expiry; you can shorten or revoke them at any time.
7. Acceptable use
- No fraud, no impersonation, no creating accounts in another person’s name.
- No uploading records that aren’t your child’s or that you have no consent to upload.
- No scraping, reverse-engineering, automated bulk extraction, or attempts to probe the security of the service.
- No uploading malware, illegal content, or content that violates Indian law.
8. Pricing
Defyd.Health is free during the MVP. If we introduce paid plans, we will notify existing users at least 30 days in advance. Existing free accounts will be grandfathered onto a free tier for at least 12 months from the date paid plans go live.
9. Termination
Either side may terminate at any time. You can delete your account from settings. We may suspend or terminate accounts that breach these terms or applicable law. On termination, you have 30 days to export your data; after that, the cascade delete described in the privacy policy runs.
10. Intellectual property
You own your data. You retain all rights to the documents and information you upload. You grant Defyd.Health a limited, non-exclusive licence to process that data only for the purposes set out in the privacy policy.
Defyd.Health owns the application, its code, its prompts, its brand, and the derived organisation logic. Nothing in these terms transfers those rights to you.
11. Indemnity, liability, warranties
The service is provided on an “as is” basis. To the maximum extent permitted by Indian law, Defyd.Health disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.
Our aggregate liability arising from your use of the service, on any basis, is capped at the total fees you paid in the 12 months before the claim. While the service is free, that cap is ₹0. None of this limits liability that cannot be limited under Indian law (such as gross negligence or wilful misconduct).
You agree to indemnify Defyd.Health against third-party claims arising from your breach of these terms or your unlawful use of the service.
12. Governing law and disputes
These terms are governed by the laws of India. Courts in Bangalore, Karnataka, have exclusive jurisdiction. Either side may, before filing in court, request arbitration under the Arbitration and Conciliation Act, 1996, with a single arbitrator seated in Bangalore.
13. Changes
Material changes are notified by email and an in-app banner at least 30 days before the new version takes effect.
